Meeting 4 - Draft
November 1, 2005


Present: Chairman Wayne Jostrand, Skip Kendrick, Len Sussman

Also Present:  Paul DeCoste, Town Planner, Town of Chatham; John Connery, Connery Associates and a number of interested Chatham residents

Call to Order – 2:40 PM Wayne Jostrand called the meeting to order.  

Review of proposed zoning by-law rewrite draft (including revisions, see Handout 1 attached):
        
Section II

1.      HO 1 page 1 A 2, 3 – General discussion re Building Inspector, Zoning Enforcement Officer, and Building Commissioner. – decided to leave Building Inspector as is.
2.      HO1 page 1 B 2 - Mr. DeCoste will review documentation and the subcommittee will revisit.
3.      HO 1 page 2 D – coverage is handled as a dimensional issue.
4.      HO 1 page 7 4 – scientific research – Mr. Connery will add a definition for this.  Mr. Jostrand recommended that the subcommittee accept this to be presented to the full Planning Board (PB) for public comment.
5.      HO 1 page 9 Section III – Mr. Connery said that Section references may change as document is reviewed and revised.
6.      Mr. Connery will draft a general purpose statement for each District.
7.      Draft – Removing “Downtown Residential Transition District” will mean re-naming sections.
8.      Draft – sections N, O, P are referenced all the way through.
9.      Draft page 25 N – Congregate Residence – State definition is basically what is found in draft page 131.  We want to allow assisted living, summer residences, and private shelters.  Preserve congregate including as defined on page 131.  Mr. DeCoste will contact the Zoning Board of Appeals (ZBA) to see if they are doing annual re-issuances of Special Permits for congregate housing.
10.     Draft page 26 N b – can be deleted - it is covered elsewhere.  Board of Health (BOH) regulations are what governs.
11.     Draft page 25 N 1 A – after “two (2) beds” add “not to exceed six individuals per building”.
12.     General discussion re differences in Draft page 26 items 2 and 3 – Item 2 is dwelling in a mixed use building.  Item 3 is dwelling incidental to a commercial or industrial use.
13.     Draft page 26 2 d and f – delete
14.     Draft page 27 4 a 1 – change to no more than two dwellings units.  Change verbiage on this section to reflect two-family in place of multi-family.
15.     Draft page 27 4 a 4 – add “and building coverage requirements are met”.
16.     Draft page 27 4 a 6 and 7 to be deleted.
17.     Draft page 28 b – recommend discussion of this by full PB as to whether Special Permit should be by PB or by ZBA.  Mr. Connery recommends that it be PB.  Mr. Sussman is concerned about having only one Board responsible for making decision.  Paul Kelley also expressed concern about the balance of power in having both Special Permit and Site Plan Review lie with the PB.  This will be held until a later date.  Same paragraph – delete “sewage disposal”.
18.     John Payson asked why have both congregate and single family.  Mr. Connery will clarify congregate.
19.     David Burns would like to see just the subcommittee argue these points – not the consultant.
20.     Steve Buckley said he has been following this process fairly closely but could have missed something important like congregate housing.  When someone tells Mr. Connery to change something, it is not Mr. Connery’s draft anymore.  Mr. Jostrand explained the process.  The full Planning Board had decided they needed to have the draft document reviewed.  The subcommittee does that and then brings their recommendations to the full PB for their review
