Meeting 6 - Draft
November 29, 2005
Present: Chairman Wayne Jostrand, Skip Kendrick, Len Sussman
Also Present: Paul DeCoste, Town Planner, Town of Chatham; Judith Barrett, Community Opportunities Group and a number of interested Chatham residents.
Call to Order – 2:35 PM – Wayne Jostrand called the meeting to order. He mentioned receipt of two e-mails from David Burns of the Wets Chatham Village Association. He asked Dr. Burns for clarification on the differences between the e-mails. The second message supercedes the first. The comments contained in that e-mail will be reviewed as the sections come up. He asked that all input for the proposed draft review also be copied to the Town Planner. Mr. Jostrand also has a memo from Deb Eckert and John and Sweeney dated November 9, 2005. Copies were provided to subcommittee members.
Review of proposed zoning by-law rewrite draft commenced with review of the changes made by Ms. Barrett subsequent to the November 15th subcommittee meeting (see Handout 1 attached):
1. Page 1 – discussion re medicine – leave as is for now.
2. Page 4 – deletion of d. OK
3. Page 4 – change from five to 8 in 2.
4. Draft page 39 Section P – 1b discussion whether to remove all or part of P as it is covered elsewhere. Delete all of Section P.
5. Page 40 P 2 – addressed in Site Plan Review.
6. Page 40 Q generally same as existing by-law.
7. Page 40 Q 1A time frames not realistic. Should allow temporary use of trailer or mobile home on lot during construction. State law says must allow for 12 months in case of fire or other natural disaster.
8. Page 40 Q1, b general discussion re parking and storing.
9. General practice in by-laws is not to list prohibited uses because then it can be questioned “If it is not listed as prohibited, does that mean it is permitted?”
10. Q 1 C – how many requests for tents does the Board of Selectmen (BOS) get each year? If, it is in general by-law, remove from this section. Mr. DeCoste will check on frequency of this.
11. Page 40 – 41 Q 2 – Adult Use – can not prohibit but can regulate. Keep in industrial.
12. Need to begin discussion of districts – page 15 West Chatham.
At this point, the meeting took a 15 minute break
The subcommittee then focused on John Connery’s memo dated November 23, 2005 (see Handout 2 attached):
13. Page 1 C1a – should be dwelling.
14. General discussion regarding multi-family, multi-unit and multi-development – single family detached units on single lot – multi-family dwelling = three or more dwelling units in one building – multi-family development = one or more dwelling units on one or more lots – cluster housing = multiple dwellings clustered together on one lot to allow for open space.
15. Draft page 136 – definition re multi-family.
16. General discussion re density, nitrogen, floor area ratio, lot coverage.
17. Handout 2 Page 1 c 1 (a) – leave as is for now.
18. Handout 2 Page 1 c 1 (c) – general discussion re lot coverage.
19. Draft page 14, South Chatham – Mr. Jostrand read an excerpt from a letter sent by Toddy Everett.
20. Mr. DeCoste read an introduction for South Chatham written by Mr. Connery in his memo of November 9, 2005.
21. In the Comprehensive Long Range Plan (CLRP), the overarching goal is to prevent sprawl.
22. Regarding West Chatham, Mr. Jostrand cited the e-mail from Dr. Burns regarding the Mass General Laws.
23. Draft page 16 – Nursing Home – delete.
24. General discussion re residential in West Chatham business district.
25. Leave congregate in West Chatham until areas are defined. Then a general discussion ensued regarding defining the exact area of the West Chatham business district.
At this point a general discussion was held regarding the date and time of the next subcommittee meeting. It was decided to have the meeting on December 8, 2005 at 2 PM subject to Mr. Connery’s schedule and room and secretarial availability. Subsequently, it was decided to schedule the meeting for December 6, 2005 at 2 PM in the Annex conference room.
Adjournment – The meeting adjourned at 6:40 PM.
