Working Session
Meeting 7 - Draft
December 6, 2005


Present: Chairman Wayne Jostrand, Skip Kendrick, Len Sussman

Also Present:  Paul DeCoste, Town Planner, Town of Chatham; John Connery, Connery Associates; and a number of interested Chatham residents.
Call to Order – 2:05 PM Wayne Jostrand called the meeting to order.  He mentioned receipt of an e-mail from Norma Pacun and Gloria Freeman (see Handout 1 attached).  A memo was also received from Deborah Ecker and John Sweeney (see Handout 2 attached).

Review of proposed zoning by-law rewrite draft:
        
1.      Handout 2 Page 2 comment 4 – general discussion re allowing a residential unit on the first floor in a mixed use building.  In Draft page 26 keep 2 c as is.
2.      Handout 2 page 2 comment 5 – not in all districts.  Residential single family – yes, in South Chatham – North Chatham by Special Permit - only single family in commercial is in South Chatham.  Ok as in draft.
3.      Handout 2 comment re Residential Transition District – ok as is.
4.      John Payson letter re draft page 25 comments re congregate housing
5.      Draft page 16 Commercial uses d by Special Permit – eliminate auto body repair shop in West Chatham.  Ok to delete.
6.      Comment – eliminate cinema or theater in West Chatham.  All agree to delete and have in Crowell Road area.
7.      General discussion re size of restaurant – will put in reference to size – maximum size about same size as Pates.
8.      General discussion re veterinary clinic – can limit floor area for overnight patients.  Have already taken out “Kennel”.  Clinic for in patient care only – not boarding.
9.      General discussion re commercial greenhouse.  Mr. Connery will add a definition for this item.  Maybe add word “retail”.  Concern about how it looks - will decide after Mr. Connery writes the definition.
10.     Take out food – defined on draft page 133 – no seats – only for take out.  Change to may or may not be consumed on premises – basically, don’t want a drive through.
11.     Mr. Connery presented a revised map for the West Chatham area.  He reviewed the map and discussed the areas.  The subcommittee members had suggestions for revisions to the map.  Mr. DeCoste will get together with Paul Lagg to make requested changes to map.
12.     Draft page 17 G Crowell Road e 3 – 4,000 square feet - don’t want to limit to percent of lot coverage – if buy a number of lots, could build a monster building.  Also don’t want to be able to combine uses and have a huge building.
Mr. Connery will add verbiage.  Look at properties in Town and compare square feet and building shape and size – Pizza House, Larry’s, High Tide, Northport.  
   
Mr. Jostrand raised the question of how to proceed.  There is a regular scheduled meeting on December 20th.  It will be a meeting of the full Planning Board Zoning By-law Rewrite Committee (PB-ZBR).  The subcommittee will update the full Board on how the review is going.  The Historic Commission would like to appear before the PB-ZBR to present their concerns – how to protect historic properties.  The subcommittee will review Section 2 with the full PB.  Mr. Connery will provide an introduction and explain what the subcommittee has done.  Mr. Sussman would like to provide documentation to the members ahead of time so they can read and prepare comments and questions.  Mr. Kendrick feels the subcommittee should provide explanations as to why it is making the recommendations that are being made.  Section 2 will be provided as a complete document as was done with Section 1.

Mr. Sussman left at 5:10 PM.  

Mr. Connery will put together a draft with comments at the end.  

Mr. Connery raised a question regarding the previous week’s discussion on mobile home occupancy during construction.  He recommends that up to two extensions of six months each be granted – for a total of 2 years.  The members agreed.

The members decide to have a subcommittee meeting on Monday, December 19th at 2 PM.  The secretary will reserve a room, post a meeting and notify the members.  That meeting will continue the Crowell Road discussion.
