Selectmen's Meeting Minutes 4/22/08
Board of Selectmen’s Meeting
April 22, 2008


Vice Chairman Connors called the meeting to order at 4:00PM with Mrs. Bohman, Mr. Bergstrom, Mr. Summers and Town Manager Mr. Hinchey present.

Mr. Bergstrom moved the Board of Selectmen vote to approve the minutes of the April 15, 2008 Board of Selectmen’s meeting.  Mr. Summers seconded the motion and the Board of Selectmen voted three in favor, one abstention (Mrs. Bohman did not attend the meeting on April 15).

Public Forum

Mr. Stephen Buckley suggested the Board of Selectmen publish their public forum policy on the Town’s  web site along with instructions on how to get on the Board’s agenda.

Public Hearing - Transfer of Alcohol License

Ms.  Connors called the public hearing to order which was duly posted for this date.

Mr. Jeffrey Largay and Mr. Garth Bradley attended this meeting.  Mr. Largay told the Board of Selectmen the operations would continue as they have been.

Mrs. Bohman moved the Board of Selectmen vote to approve the transfer of License at the Epicure to Jeffrey Largay.  Mr. Summers Seconded the motion and the Board of Selectmen voted unanimously in favor.

Festival of the Arts - Request to Place Banners

Ms. Mary Allen, representing the Festival of the Arts, told the Board they applicants have revised their request to place banners along Main Street.  The have decreased the number of banners from twelve to eight.  The banners will be hung on August 8th and removed August 18th.  

Mr. Bergstrom moved the Board of Selectmen vote to grant this request.  Mrs. Bohman seconded the motion and the Board of Selectmen voted unanimously in favor.

Maritime Festival - One Day Alcoholic Beverage License

Ms. Karen Murdoch addressed the Board of Selectmen.  Ms. Murdoch is seeking permission to use the Town Hall parking lot and the municipal Fish Pier and requesting a one day beer and wine permit for the 2008 Chatham Maritime Festival which will be held on Saturday May 10, 2008.  The group would like to erect the tent on May 9.

Mrs. Bohman moved the Board of Selectmen vote to grant the request for the use of Town Property.  Mr. Bergstrom seconded the motion and the Board of Selectmen voted unanimously in favor.
Mrs. Bohman moved the Board of Selectmen grant the request for a one day beer and wine license. Mr. Bergstrom seconded the motion.  From the gallery, Mrs. Avellar suggested the alcohol be confined to the tent.  It was noted the children’s activities end at 4:00PM and the service of beer and wine will not commence until 5:00PM.  Also noted was the presence of Police that will be at the event.  Mrs. Bohman asked about the food inspection permit.  Ms. Murdoch said a member of the group is working with the Board of Health.  Ms. Murdoch also told the Board the perimeter of the parking lot will be marked “no alcohol beyond this point.”

The Board voted unanimously in favor.

Spring Fling Weekend Permission to use Town Property

Mrs. Audrey Gray, representing the Merchants Association, attended this meeting.  Mrs. Gray said the merchants are seeking permission to use Town owned property for Spring Fling on May 10th.

They are also seeking permission for the outdoor sales of merchandise.  If granted permission, they  will be selling T shirts near the Chamber booth on Main Street.  

Mr. Bergstrom moved the Board of Selectmen vote to grant permission to use Town property to the Merchants.  Mrs. Bohman seconded the motion and the Board of Selectmen voted unanimously in favor.

Mr. Bergstrom moved the Board of Selectmen vote to allow the outdoor sales of merchandise by the Merchants Association on May 10, 2008.  Mrs. Bohman seconded the motion and the Board of Selectmen voted unanimously in favor.

Proclamation - Equal Pay Day Town of Chatham

Mrs. Bohman moved the Board of Selectmen proclaim April 22, 2008 Equal Pay Day in Chatham. Mr. Bergstrom seconded the motion and the Board of Selectmen voted unanimously in favor.  

Appointment - Bikeways Committee

Mr. Bergstrom moved the Board of Selectmen vote to appoint Sara Smith to the Bikeways Committee until their work is completed unless sooner revoked or until her successor is appointed.  Mrs. Bohman seconded the motion and the Board of Selectmen voted unanimously in favor.

Other Business

Mr. Summers said a letter has been received from attorneys from the Champlain Road Realty Trust saying they will allow dinghies on the beach providing the owners own a mooring in the vicinity and the beach is kept in good order.  The owners would also like indemnification from any liability.  Mr. Summers said the Town needs to be a good neighbor.

Mr. Bergstrom pointed out the Town does not own the property where the dinghies are being stored and he did not want the Town involved in any indemnification agreements.  Mr. Summers noted the Town has rights at low water.  Mr. Hinchey told the Board the Town will help facilitate the agreement if needed, but that will be the extent of our commitment.

The meeting adjourned at 4:35PM.
